Mary Alice Warford — Trespasser Evicted and Judgment Entered

 

Here is a brief overview of why we seek Mary Alice Warford and why we are entitled to payment:

  • We purchased a house on South 18th Street in Hot Springs, South Dakota, from the federal bankruptcy court trustee.
  • The bankrupt party (debtors) were someone other than Mary Warford.
  • Mary Warford was still in the house, because she had purchased the house from the debtors.
  • Mary Warford had bought the house from the debtors “on payments” with a large balloon payment.
  • Mary Warford did not make the balloon payment.
  • Because Mary Warford did not make the balloon payment, the bankruptcy court trustee foreclosed on the house and subsequently sold the asset (house) through a federal bankruptcy court-ordered sale (to us).

Yet, in spite of the fact that she was not making loan payments, balloon payments, or rent payments, Mary Warford refused to vacate the house she did not own and was not paying to occupy.

Upon buying the house from the bankruptcy court, we offered to sell Mary Warford the house, either outright or on payments, for $30,000 less than its market value.  She accepted our offer, but after weeks of stringing us along, backed out of the deal.  But, she still refused to get out of the house.

We were forced to hire an attorney to get control of and access to our own property.  We spent many thousands of dollars and many months of time, but eventually, the judge ordered Mary Warford to vacate the house and to pay us for our attorney fees, court costs, and rent for the time she trespassed in the house we owned.  You may view the judgment here.

Then, Mary’s mother died, the county sheriff’s civil deputy and we felt empathy for her, and we agreed to give her a little time to grieve and get her affairs in order.

She used that time against us, skipping town with no forwarding address.

No good deed goes unpunished.
